Marijuana Risk Factors. Please be advised that the concepts of “medical marijuana,” “retail marijuana,” and “adult use marijuana” do not exist under federal law. The Federal Controlled Substances Act classifies “marihuana” as a Schedule I drug. 21 U.S.C. § 812 (c)(Schedule 1)(c)(10). Under federal law, a Schedule I drug or substance has a high potential for abuse, no accepted medical use in the United States, and a lack of accepted safety for use of the drug under medical supervision. 21 U.S.C. § 812(b)(1). As such, marijuana-related practices or activities, including without limitation, the manufacture, importation, possession, use or distribution of cannabis/marijuana are illegal under federal law.
